Privacy at a glance

Hosts use SparkleText to manage keyword replies, broadcasts, and inbox conversations. Subscribers text a Host's keyword or receive messages from that Host. We use information needed to run those features, and we do not sell personal information or give a Host's subscriber list to another Host or to third parties for their own marketing.

This policy explains what we collect, how service providers help us operate SparkleText, the current retention policy, and how to make a data request.

1. Introduction

Omvium LLC ("SparkleText," "we," "us," "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect information when you use our SMS messaging platform ("Service"). This policy applies to both Hosts (businesses using our platform) and Subscribers (individuals who text keywords or receive messages from a Host).

2. Information We Collect

From Hosts (Account Holders):

  • Name, business name, email address, and phone number used to create or access an account
  • Payment information (processed and stored by Stripe; we do not store card numbers)
  • Phone numbers provisioned for a Host's program
  • Keywords, auto-reply messages, and links you configure
  • Usage data including subscriber counts, message logs, and keyword activity

From Subscribers (End Users):

  • Phone number and message content received when you text a SparkleText-powered number
  • A display name a Host may assign to identify a Subscriber in that Host's dashboard
  • Keywords, message timestamps, and conversation records
  • Opt-in and opt-out status

Automatically Collected:

  • IP address, browser type, device information, and pages visited (for website visitors)
  • Cookies used for authentication and session management
  • If you choose to allow it, a short-lived first-party measurement token and limited source category to understand how visitors reach pricing and complete setup. This measurement excludes message content, phone numbers, email addresses, keyword text, full referrer URLs, IP addresses, and browser fingerprints.

3. How We Use Your Information

  • To provide, operate, and maintain the Service
  • To process payments and manage subscriptions
  • To provision and manage phone numbers
  • To deliver keyword replies and broadcasts to Subscribers on behalf of Hosts
  • To provide inbox conversations and service notifications
  • To enforce plan limits and usage policies
  • To send transactional emails (account confirmation, billing receipts, plan limit warnings)
  • To comply with legal obligations including TCPA compliance
  • To detect and prevent fraud or abuse

4. How We Share Your Information

We do not sell personal information. Each Host's subscriber list is isolated from other Hosts and is available to that Host for its own program. We do not provide subscriber information to third parties for their own marketing. We do disclose information to service providers as needed to operate SparkleText:

  • Messaging and verification providers: Phone numbers, message content, and verification details are processed to provide SMS delivery, inbound message handling, and account verification.
  • Stripe: Payment and billing information is processed by Stripe. We do not store credit card numbers.
  • Hosting, database, and service operations:Account, subscriber, message, and configuration data are stored and processed to run the Service.
  • Email and notification providers: We use email and push-notification services to send account and service notifications. A push notification can include a Subscriber's name or phone number and a link to a conversation; email fallback does not include the message body.
  • Legal Requirements: We may disclose information if required by law, subpoena, or government request.

5. Subscriber Data and Host Responsibility

  • Hosts are the data controllers for their Subscriber data. SparkleText acts as a data processor on behalf of Hosts.
  • Hosts must not sell, share, or misuse Subscriber phone numbers or data in violation of applicable laws.
  • Subscribers can opt out at any time by replying STOP. SparkleText automatically processes opt-out requests.
  • Hosts can download a CSV of their currently opted-in subscribers from the Subscribers dashboard. That CSV includes the subscriber name, phone number, opt-in date, and source keyword; it is not a complete account or inbox export.

6. SMS Text Messaging Privacy

When you text a keyword to a SparkleText-powered phone number, we collect and process the following data:

  • Your mobile phone number
  • The keyword(s), message content, and timestamps we receive
  • Your opt-in and opt-out status

This data is used to deliver keyword replies and broadcasts on a Host's behalf, provide inbox features, and maintain opt-in and opt-out records. We do not sell, rent, or share your phone number with third parties for marketing or promotional purposes. A Host cannot access another Host's subscriber data. Messaging, verification, hosting, and notification providers process data as needed to operate those features. No purchased contact lists are used. You may opt out at any time by replying STOP; that request is different from an account or privacy deletion request. For questions about your SMS data, contact us at support@sparkletext.com.

7. Data Retention

  • Active accounts: Data is retained for as long as your account is active and you have an active subscription.
  • Canceled accounts: Data is retained for 30 days after account cancellation, then permanently deleted.
  • Message logs: Retained for 90 days for compliance and troubleshooting, then automatically purged.
  • Opted-out subscribers: Opt-out records are retained to ensure we do not re-subscribe individuals who have opted out.
  • Optional discovery measurement expires after 30 days; expired records are deleted during a weekly manual review. You can withdraw using the measurement preference link. Browser collection stops immediately. Once the server confirms withdrawal, linked activation data is deleted and further measurement is blocked. If confirmation fails, the preference control shows a pending state and keeps the deletion token so you can retry. An unlinked hash remains until expiry to prevent in-flight requests from restoring withdrawn data. Account deletion removes the linked activation record.

8. Data Security

We use industry-standard security measures to protect your data including encryption in transit (TLS/SSL), encrypted database connections, account verification, and PCI-compliant payment processing via Stripe. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

9. Your Rights and Data Requests

You have the right to:

  • Access your personal data. Hosts can download a CSV of their currently opted-in subscribers from the Subscribers dashboard; that export contains the subscriber name, phone number, opt-in date, and source keyword, rather than a complete account or inbox export.
  • Correct inaccurate data (update your profile in the dashboard)
  • Delete a Host account in the mobile app's Settings, or ask support about a privacy request
  • Request a portable copy of your personal information or help with account or subscriber information
  • Opt out of marketing communications (we do not send marketing emails)

California residents have additional rights under the CCPA. To make a privacy request, email us with whether you are a Host or Subscriber, the email address or phone number associated with the account or the number that received messages, and the action you want us to take. 10. Children's Privacy

SparkleText is not intended for use by anyone under 18 years of age. We do not knowingly collect personal information from children. If we learn that we have collected data from a child under 18, we will delete it promptly.

11. Third-Party Links

Auto-reply messages configured by Hosts may contain links to third-party websites. SparkleText is not responsible for the privacy practices of those websites. We encourage Subscribers to review the privacy policies of any linked sites.

12. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. The "Last updated" date at the top reflects the most recent revision.
